Terms of use
These terms are the agreement between you and Kitom when you use the app. We've written them to be understood. By creating an account you confirm that you have read and accept them. The Spanish version is the reference version.
Kitom does not replace a vet. It helps you observe your pet and gives you general guidance, but it doesn't confirm illnesses or prescribe treatments. In an emergency (trouble breathing, seizures, bleeding or unable to stand), go to a vet without waiting.
1. Who provides the service
Kitom is developed and provided by David Zarzavilla Borrego, a private individual resident in Spain ("Kitom", "we"). Contact: dzarzavillaborrego@gmail.com.
2. What Kitom is
Kitom is an app that supports the emotional and behavioural wellbeing of dogs and cats. It lets you:
- create your pets' profiles;
- log how they are each day and see their history, streaks and achievements;
- keep an agenda with reminders;
- ask for AI guidance based on a photo and the signs you notice;
- share a pet with other people (co-owners).
3. It is not veterinary care
Nothing Kitom shows is a medical assessment, a prescription or professional veterinary advice. Kitom doesn't examine your pet and can't know everything that is happening to them. The information helps you observe better and decide when to see a vet. You are responsible for your pet's health and care, and whenever in doubt you should see a vet. Don't delay or avoid veterinary care because of something you saw in Kitom.
4. AI guidance
- The guidance is prepared by an artificial intelligence model from the photo, signs and data you provide. It is informative and indicative only: it may be incomplete or wrong.
- It shows possible causes, care at home and warning signs that call for a vet. It doesn't confirm any illness.
- Each account can request 3 guidance checks per month. The counter restarts on the 1st of each month. We may change this limit with prior notice.
- To prepare it we send check data to our AI provider, as explained in the privacy policy.
- If a person appears in the photo, take it again. Only send photos you have the right to use.
5. Your account
- You must be at least 16 years old.
- Your sign-up details must be true and your email must be yours.
- You are responsible for keeping your password or Google account secure and for what is done with your account. If you think someone has accessed it without permission, change the password and write to us.
- An account is personal: don't share or sell it. To have someone else look after a pet with you, invite them as a co-owner.
6. Acceptable use
When using Kitom you agree not to:
- use it for illegal purposes or to harm animals or people;
- upload content that is illegal, offensive, that you have no right to use or that shows other people without their permission;
- try to access other people's data, get around the service's limits or attack its security;
- automate requests, copy the service at scale or use it to train other AI models;
- impersonate someone else.
7. Your content
What you log (data, notes and photos) remains yours. You give us permission to store it, show it to you and to the people you share the pet with, and process it to provide the service, including AI guidance. That permission ends when you delete the content or your account, except for what remains in shared pets, as explained in the privacy policy.
The app, its design, the Kitom brand and its code belong to us or are used under licence. You may use the app for your personal use, without copying, modifying or redistributing it.
8. Sharing pets
If you invite co-owners, they will see and, depending on the role you give them, be able to edit that pet's profile, logs, agenda and checks, and they will see your name. Only invite people you trust; you can remove access at any time. Whoever accepts an invitation agrees to treat that data with respect and only to look after the pet.
9. Free service and changes
Kitom is free and includes no purchases. We do our best for it to work well and without interruptions, but we provide it as is and as available: there may be bugs, maintenance pauses or changes to features. If paid features are offered in the future, they will be optional and we will present their conditions before you sign up.
We may update these terms. If the change is significant, we will let you know in the app or by email before it applies. If you don't agree, you can stop using Kitom and delete your account.
10. Liability
To the extent permitted by law, Kitom is not liable for:
- decisions about your pet's health or care that you take based on the app without consulting a vet;
- errors or omissions in the AI guidance;
- loss of data that was never uploaded from your phone, or service interruptions beyond our control;
- the use made of the data by the people you share a pet with.
None of the above limits the rights you have under consumer protection law, or our liability for wilful misconduct, gross negligence or harm to people's life or health where the law does not allow it to be limited.
11. Leaving and termination
- You can stop using Kitom and delete your account whenever you want, from the app (Profile › Your account and settings › Delete account) or as explained in Delete account.
- We may suspend or close an account that seriously breaches these terms or the law. Unless a risk or a legal obligation prevents it, we will warn you first and you will be able to download your data.
- If we ever stop providing the service, we will give at least 30 days' notice so you can download your data.
12. Governing law
These terms are governed by Spanish law. If you are a consumer, you are also protected by the mandatory rules of your EU country of residence, and you may go to the courts of your place of residence. Before getting there, write to us and we'll try to sort it out.
If any clause is found invalid, the rest remains in force.
